Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Hostl platform, including hostl.cloud, app.hostl.cloud, message.hostl.cloud, and all related services (collectively, the "Services"). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Acceptance of terms

By accessing or using the Services, you confirm that you are at least 13 years old, that you have read and understood these Terms, and that you agree to be bound by them. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of services

Hostl provides a universal interaction and identity platform that allows users to send and receive interactive messages including approval requests, RSVP invitations, polls, and forms. The Services include:

  • A personal @handle and public profile at hostl.cloud/u/yourhandle.
  • An inbox for sending and receiving interactive messages.
  • Tools for creating approvals, RSVPs, polls, and forms.
  • A verification badge system for establishing identity and trust.
  • Access via web at message.hostl.cloud and app.hostl.cloud.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice.

3. Accounts and handles

To use most features of the Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your account credentials secure and not share them with others.
  • Notify us immediately at legal@hostl.cloud if you suspect unauthorized access to your account.
  • Be responsible for all activity that occurs under your account.

Your @handle

Your @handle is your unique identifier on Hostl. Handles are assigned on a first-come, first-served basis. We reserve the right to reclaim handles that are inactive, impersonating others, or violating these Terms. We may also reserve handles for brand protection purposes.

You may not use a handle that impersonates another person or entity, is offensive or misleading, or violates any third-party rights.

4. Acceptable use

You may use the Services only for lawful purposes and in accordance with these Terms. You agree to use the Services in a way that:

  • Complies with all applicable local, national, and international laws and regulations.
  • Respects the rights and dignity of other users.
  • Does not interfere with or disrupt the integrity or performance of the Services.
  • Does not attempt to gain unauthorized access to any part of the Services or related systems.

5. Prohibited conduct

You may not use the Services to:

  • Send spam, unsolicited messages, or mass communications without recipient consent.
  • Harass, threaten, intimidate, or harm any person.
  • Impersonate any person, organization, or entity.
  • Distribute malware, viruses, or any other harmful code.
  • Collect or harvest personal information from other users without their consent.
  • Engage in phishing, fraud, or any deceptive practice.
  • Violate any intellectual property rights of Hostl or third parties.
  • Use automated tools to scrape, crawl, or extract data from the Services without our written permission.
  • Circumvent any security or access control measures.
  • Use the Services to facilitate illegal activity of any kind.
  • Send content that is defamatory, obscene, or violates any applicable law.

Violation of these prohibitions may result in immediate account suspension or termination and may be reported to law enforcement authorities.

6. Your content

Ownership

You retain ownership of all content you create and send through the Services, including messages, forms, and any other materials ("Your Content"). By using the Services, you grant Hostl a limited, non-exclusive, royalty-free license to store, process, and transmit Your Content solely as necessary to provide the Services to you.

Responsibility

You are solely responsible for Your Content and the consequences of sharing it. You represent and warrant that Your Content does not violate any law, infringe any third-party rights, or violate these Terms.

No training use

We do not use Your Content to train machine learning or artificial intelligence models. Your message content is used only to deliver the Services.

Removal

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or otherwise objectionable.

7. Intellectual property

The Services, including all software, design, text, graphics, logos, and other materials, are owned by Hostl and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Services without our written permission.

The Hostl name, logo, and all related marks are trademarks of Hostl. You may not use our trademarks without our prior written consent.

8. Verification badges

Hostl offers a voluntary verification badge system. Badges are issued at our sole discretion following a review process. A badge indicates that we have taken reasonable steps to verify the identity or status of an account at the time of verification. Badges do not constitute an endorsement of any account holder or their activities.

We reserve the right to revoke any badge at any time if we determine that the account no longer meets our verification standards, has violated these Terms, or if the badge was issued in error.

Attempting to obtain a badge through false or misleading information is a violation of these Terms and may result in account termination.

9. Termination

By you

You may delete your account at any time from your account settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

By us

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we determine that your use of the Services poses a risk to other users or to the platform. We will make reasonable efforts to notify you before termination except where doing so would be harmful or legally prohibited.

Effect of termination

Upon termination, your right to use the Services ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, and governing law.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the platform.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOSTL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HOSTL IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hostl and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services, Your Content, or your violation of these Terms.

13. Governing law and disputes

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not as part of a class action.

14. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the Services and may delete your account.
